MINUTES, OCONEE COUNTY COUNCIL MEETING

 

                        The Oconee County Council met Tuesday, June 7, 2005 at 7:00 PM in Council Chambers, 415 South Pine Street, Walhalla, SC with all Council Members,  County Administrator Ron Rabun, Clerk to Council & Mr. Norton, County Attorney present.  

 

Press:

 

                        Members of the press notified (via mail): Keowee Courier, Westminster News, Daily Journal, Anderson Independent, WGOG Radio, WYFF TV, WLOS TV WSNW Radio & WIRX Radio.

 

                        Members of the press present:  Ray Chandler – Daily Journal, Dave Williams – Anderson Independent & Dick Mangrum – WGOG Radio.

 

Other Organizations Notified:

 

                        Also notified were the Oconee County Tax Payers Association, Citizens for Recreation Center and the Oconee County Democratic Party.

 

Call to Order:

 

                        Chairman Ables called the meeting to order.   

 

Invocation:

 

                        Mr. Rinehart gave the invocation.

 

Pledge of Allegiance:

 

                        Mr. Norton led the pledge of allegiance to the US Flag.

 

Minutes:

 

                                Mr. Lyles made a motion, seconded by Mr. Rinehart, approved 5 – 0 that the minutes of the regular meeting held May 17, 2005 be adopted as printed.

 

 

 

 

Minutes, Oconee County Council Meeting                                      June 7, 2005

 

Interlocal Agreement:

 

                        Mr. Lyles made a motion, seconded by Mr. Crumpton, approved 5 – 0 that the attached Interlocal Agreement between Oconee County and Oconee Memorial Hospital be adopted to include the amendment in Section B: “for the purpose of constructing a patient tower”.

 

Public Hearing Regarding Ordinance 2005-06:

 

                        Council conducted a public hearing to receive written and/or oral comments regarding Ordinance 2005-06, “AN ORDINANCE TO PROVIDE FOR FLOOD DAMAGE PREVENTIONS”.

 

                        There was no one present with written and/or oral comments regarding this ordinance.

 

Tipping Fees for Cities:

 

                        Mr. Greg Dietterick, Administrator, City of Seneca, addressed Council urging that tipping fees at the C&D Landfill not be imposed on the cities and that other options be explored.

 

Sheriff’s Department:

 

                        Mr. Moore made a motion, seconded by Mr. Crumpton, approved 5 – 0 that the bid for a step van for the Sheriff’s Department be awarded to Georgia Commercial Vehicles at a total cost of $42,618.11 and that the remaining funds in that account be carried forward in the 2005-06 appropriations ordinance for equipping the vehicle.  (See attached bid sheet)

 

 Lease of County Owned Property:

 

                        The request of an individual to lease County owned property located on South Broad Street adjacent to the Heritage Center was referred to the Real Estate, Facilities & Land Management Committee for a recommendation to Council.

 

Aeronautics (FBO) Lease:

 

                        Mr. Lyles made a motion, seconded by Mr. Moore, approved 5 – 0 that the attached lease between Oconee County and John R. Van Surdam d/b/a Van Surdam Vintage Aircraft for an aircraft fixed base operator at the Oconee County Airport be adopted.  (See attached lease)

Ordinance 2005-06:

 

                        Council unanimously adopted Ordinance 2005-06, “AN ORDINANCE TO PROVIDE FOR FLOOD DAMAGE PREVENTION” as amended in Section 4.8 to include appeals will be made to the Building Code Board of Appeals.

 

Ordinance 2005-09:

 

                        Mr. Lyles made a motion, seconded by Mr. Ables, approved 5 – 0 that Ordinance 2005-09, “AN ORDINANCE AUTHORIZING THE TRANSFER OF REAL PROPERTY TO OCONEE MEMORIAL HOSPITAL, INC.” be adopted on first reading.

 

Ordinance 2005-10:

 

                        Mr. Moore made a motion, seconded by Mr. Lyles, approved 4 – 1 (Mr. Crumpton voting against) that Ordinance 2005-10, “THE FISCAL YEAR 2005-06 BUDGET APPROPRIATIONS ORDINANCE FOR OCONEE COUNTY” be adopted on first reading in title only.

 

Ordinance 2005-11:

 

                        Mr. Moore made a motion, seconded by Mr. Lyles, approved 5 – 0 that Ordinance 2005-11, THE FISCAL YEAR 2005-06 BUDGET APPROPRIATIONS ORDINANCE FOR THE SCHOOL DISTRICT OF OCONEE COUNTY” be adopted on first reading in title only.

 

Ordinance 2005-12:

 

                        Mr. Ables made a motion, seconded by Mr. Lyles, approved 3 – 2 (Mr. Moore & Mr. Crumpton voting against) that Ordinance 2005-12, “AN ORDINANCE AMENDING THE DISTRIBUTION OF THE FEE IN LIEU OF TAX RECEIVED BY OCONEE COUNTY PURSUANT TO THE JOINTLY OWNED AND OPERATED INDUSTRIAL/BUSINESS PARKS IN CONJUNCTION WITH PICKENS COUNTY DATED APRIL 21, 1998 AND AMENDED ON DECEMBER 1, 1998, ON DECEMBER 21, 1999, APRIL 4, 2000, JULY 15, 2003 AND MAY 17, 2005 AND IN CONJUNCTION WITH WILLIAMSBURG COUNTY DATED JULY 7, 1994 AND AMENDED ON DECEMBER 6, 1994; SUCH INDUSTRIAL/BUSINESS PARKS BEING GEOGRAPHICALLY LOCATED IN PICKENS COUNTY AND OCONEE COUNTY AND WILLIAMSBURG COUNTY AND OCONEE COUNTY, BOTH ESTABLISHED PURSUANT TO SOUTH CAROLINA CODE OF LAWS OF 1976 §4-1-170, ET SEQUITUR, AS AMENDED; SO AS TO PROVIDE FOR THE DISTRIBUTION OF FEES IN LIEU OF AD VALOREM TAX WITHIN OCONEE COUNTY, INCLUDING TO THE RELEVANT TAXING ENTITIES” be adopted on first reading in title only.

Minutes, Oconee County Council Meeting                                      June 7, 2005

 

Commission Appointments:

 

                        Council voted unanimously to appoint Ms. Kim Alexander to represent District I on the Economic Development Commission.

 

                        Council voted unanimously to appoint Mr. Thomas Luke to represent District III on the Aeronautics Commission.

 

Road & Transportation:

 

                        The Oconee County Road & Transportation Committee scheduled a meeting July 8, at 9:00 am in Council Chambers to discuss various roadway needs.

 

Law Enforcement, Public Safety, Health & Welfare:

 

                        The Oconee County Law Enforcement, Public Safety, Health & Welfare Committee scheduled a meeting Tuesday, June 21, 2005 prior to the Council Meeting.

 

Real Estate, Facilities & Land Management:

 

                        Mr. Lyles, Chair, Real Estate, Facilities & Land Management Committee, informed Council the committee had met with representatives of Heritage Museum prior to the Council Meeting and expressed support for the museum.

 

Heritage Corridor:

 

                        Mr. Moore made a motion, seconded by Mr. Crumpton, approved 5 – 0 that the Arts & Historical Commission be asked to make a recommendation of someone to represent Oconee County on the Heritage Corridor to Council.

 

Administrator’s Report:

 

                        Mr. Rabun informed Council that lightening had damaged the lighting, the air conditioner and generator at the Law Enforcement Center.

 

                        Mr. Rabun also informed Council he would be attending the County-City Managers Meeting June 22 – June 25, 2005 in Hilton Head.

 

County Flag:

 

                        Mr. Crumpton made a motion, seconded by Mr. Lyles, approved 3 – 2 (Mr. Rinehart & Mr. Ables voting against) to adopt as the County flag a design presented to Mr. Crumpton by a member of the Arts & Historical Commission.

Public Comment Session:

 

                        Dr. Marian McMillan addressed Council regarding the interlocal agreement between Oconee County and Oconee Memorial Hospital.

 

                        A gentleman addressed Council regarding the referendum for the Corinth-Shiloh Fire District.

 

                        Mr. Thomas Coward, Mayor, Town of Salem, addressed Council regarding recreation funds.

 

                        Ms. Jeanne Ward, President, Oconee Memorial Hospital, addressed Council in appreciation regarding the adoption of the interlocal agreement between Oconee County and Oconee Memorial Hospital.

 

                        Mr. Marshall Parker addressed Council regarding the interlocal agreement between Oconee county and Oconee Memorial Hospital.

 

                        Mr. Jay Brown addressed Council regarding the County budget.

 

                        Mr. B. J. Littleton addressed Council regarding the County Road Department, the dismissal of Ms. Ann Hughes and the Delegation Office.

 

                        Ms. Donna Tribble addressed Council regarding the interlocal agreement between Oconee County and Oconee Memorial Hospital.
